1. Information regarding the operation of the Website.
1.1 We inform you that the recruitment website www.nycjobs.co.uk/ www.resourcingsolution.co.uk is operated by Tribepad Limited (the “Website”) on behalf of North Yorkshire Council (“the Council”, “us”, “our” or “we”). “You” and “Your” means you as the user of our Website.
1.2 We have set out the terms under which we are providing You with access to our Website. These include the terms and conditions that govern:
1.2.1 Your use of the Website (including Your rights to link to the Website) as set out in these (the “Terms of Use”);
1.2.2 our use of cookies on the Website (see our separate “Cookies Policy[a]”); and
1.2.3 how we will use and protect information about You (see our separate “Data Protection Policy”).
Collectively these documents are termed as the “Terms and Conditions”.
1.3 Your use of our general North Yorkshire Council website is governed under separate conditions and these Terms and Conditions should be read in conjunction with the general website terms and conditions (see our “Terms and conditions | North Yorkshire Council”).
1.4 Your attention is drawn to Clause 8 of these Terms and Conditions “Liability”.
1.5 We advertise vacancies on the Website on behalf of other organisations. If You apply for such a vacancy and encounter issues with the information provided You will be directed to the employing organisation.
2. Use of this Website
2.1 If You do not agree to these Terms and Conditions You should not use the Website.
2.2 You should read all the Terms and Conditions prior to using the Website. You should also save and/or print out a copy of these Terms and Conditions for future reference. We shall have the right, at our sole discretion and at any time, to change or modify these Terms and Conditions, such change shall be effective immediately upon posting to the Website. You are responsible for regularly reviewing these Terms of Use to obtain timely notice of any such changes, as they are binding on you. We will post a last amended date at the bottom of this page to assist such review. Your continued use of this Site after such posting shall constitute your acceptance of these Terms and Conditions as modified. 2.5.1 The minimum standard technical requirements are as follows:
2.5.1.1 Internet connection with adequate bandwidth of a minimum of 2Mbps broadband; and
2.5.2 A supported internet browser. At the time of publication, the following are supported internet browsers: Microsoft Edge, Mozilla Firefox, Google Chrome and Apple Safari. Tribepad and/or the Council may amend this list at any time.
2.6 You accept that You will access and use the Website solely and exclusively under Your own responsibility and that You are responsible for compliance with applicable local laws relating to the use of or otherwise connected with the Website. You agree not to use the Website for fraudulent purposes, and not to perform any conduct that may damage the image, interests and rights of Tribepad Limited or third parties. You also agree not to take any action in order to damage, disable or overburden the Website, or hinder, in any way, the normal use and operation of the Website.
2.7 We inform You that in the event that You breach of the contents of this Terms and Conditions, Privacy Policy or Cookies Policy, [b]we reserve the right to limit, suspend or terminate Your access to the Website, taking any technical measures necessary for that purpose.
3. Reliance on information posted
3.1 Material on the Website is provided "as is" and for information purposes only. Information published on the Website is supplied by the Council and, where indicated, by certain third parties. The Council takes every care and precaution to ensure that information published on the Website is accurate when posted and regularly updated. However, the Council does not guarantee and cannot be held liable for its accuracy or timeliness and the Council may change the information at any time without notice.
3.2 You must not rely on the information on the Website and you acknowledge that you must take appropriate steps to verify this information before acting on it. We shall not accept any liability or responsibility arising from any reliance placed on information on the Website.
3.3 Where the Council advertises vacancies on behalf of other organisations it shall not be liable for any errors, inaccuracies, discrepancies or other issues within those adverts. You are advised to contact the employing organisation directly if any such issues arise.
4. Intellectual property
4.1 Copyright and intellectual property rights in the design and architecture of the Website is owned by Tribepad. The Council owns the copyright in the content published on the Website except where otherwise indicated by a third party's proprietary notice. Images, trade marks and brands are also protected by other intellectual property laws and may not be reproduced or appropriated in any manner without written permission of their respective owners. Unless specifically prohibited by a notice published on any page, you may make a print copy of such parts of the Website as you may reasonably require for your own personal use provided that any copy has attached to it any relevant proprietary notices and/or disclaimers. All other use is prohibited.
4.2 You shall comply with the Intellectual Property law of your country.
4.3 The use of the Website by You does not imply the assignment of any intellectual and/or industrial property right over the Website and/or content on the Website.

5.1 The privacy of Your personal data is important to us. We can collect information from You through the data collection forms included in the Website. 6. Linking to our Website

6.3.1 the link will only connect to the home page of the Website;
6.3.2 in no event will the authorisation granted mean that:
6.3.2.1 the Council or Tribepad sponsors, cooperates with, verifies or supervises the content and/or services provided through the Linker Site; or
6.3.2.2 it is liable for the Linking Site content.
6.4 We reserve the right to withdraw linking permission at any time and without notice. In any case, in the event of breach of any of the above terms, Tribepad or the Council shall proceed immediately and without prior notice to deactivate the link.
7. Third party sites
7.1 Our Website and/or the contents and attachments may contain links to third party websites, for example LinkedIn, Twitter and YouTube (the “Party Sites”).
7.2 In no event does the existence of Party Sites entail any recommendation, endorsement or promotion of Tribepad or the Council with respect to the statements, content or services provided through the Party Sites. Accordingly, Tribepad and the Council shall not be liable for the content of the Party Sites or for the conditions of use or privacy policies of the Party Sites, only You are responsible for their verification and acceptance each and every time You access and uses the Party Sites.
7.3 Your browsing and interaction on any other website, including the Party Sites, is subject to that website’s own rules and policies including in relation to privacy. Please read those rules and policies before proceeding.
7.4 If You decide to visit any third Party Site, You do so at Your own risk. We are not responsible for the content, accuracy or opinions expressed in such websites. Links do not imply that we are, or our Website is, affiliated to or associated with such sites.
7.5 Please remember that when You use a link to go from our Website to another website, these Terms and Conditions including our Data Protection Policy and Cookies Policy are no longer in effect and You should read the terms and conditions included in such Party Sites.
8. Our liability
8.1 TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE EXCLUDE AND DISCLAIM ALL WARRANTIES, TERMS, CONDITIONS AND REPRESENTATIONS THAT MIGHT OTHERWISE BE IMPLIED BY LAW IN RELATION TO THIS WEBSITE. IN PARTICULAR WE DO NOT REPRESENT OR WARRANT THAT THE WEBSITE WILL BE ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. 14.1. No failure or delay by the Council to exercise any right, power or remedy will operate as a waiver of any of them nor will any partial exercise preclude any further exercise of the same or some other right, power or remedy.
